GunCerts - Terms & Conditions

These Terms & Conditions ("Terms") explain how you may use the GunCerts app and related services. Please read them carefully.

By downloading, accessing, or using GunCerts, you agree to these Terms.

1. Who we are

GunCerts is operated as a UK sole trader business.

2. What GunCerts does

GunCerts provides tools to help you prepare, organise, and manage South African firearm-related applications and documents.

  • Your application data and documents are stored locally on your device.
  • We do not submit applications on your behalf.
  • We do not provide legal advice or guarantee outcomes.
  • We aim to keep the app aligned with relevant South African legal and administrative requirements, but we do not guarantee that the app will always reflect the latest law, policy, form, process, or licencing practice at any given time.

You are responsible for ensuring all information you submit to authorities is accurate, complete, and lawful.

3. Eligibility

GunCerts is intended for use only by (a) South African citizens, or (b) foreign nationals with valid permanent residency in South Africa, who are 21 years or older and are lawfully entitled to possess firearms or apply for firearm-related licences, renewals, or competency certificates under applicable South African law. You must comply with all applicable laws and regulations when using the app.

4. Licence to use the app

We grant you a personal, non-exclusive, non-transferable licence to use GunCerts for your own lawful purposes.

You do not own the app or its software. You may not:

  • Copy or resell the app.
  • Reverse-engineer or misuse it.
  • Use it for unlawful purposes.

5. Paid features and in-app purchases

Some features require payment.

Payments are processed by:

  • Apple via In-App Purchase (iOS), or
  • Google via Google Play Billing (Android).

Apple or Google act as the merchant of record.

We:

  • Do not process or store card details.
  • Do not control payment authorization or refunds.

Refunds: Refunds are handled according to Apple's or Google's policies. Please contact Apple or Google directly for billing or refund requests.

Purchase access: We may receive limited purchase information (such as purchase status, product ID, or transaction reference) to:

  • Unlock paid features.
  • Restore purchases where supported.
  • Provide customer support and accounting records.

6. Digital content rights (UK law)

Under the UK Consumer Rights Act 2015, digital content must be:

  • As described.
  • Of satisfactory quality.
  • Fit for purpose.

If paid digital content is faulty, you may be entitled to a repair, replacement, or refund under UK law. This does not affect refunds processed by Apple or Google.

7. No guarantee of outcomes

GunCerts does not guarantee:

  • Approval of any application.
  • Processing times.
  • Acceptance by authorities.
  • That the app will always reflect the latest South African legal, regulatory, administrative, or procedural requirements.

Decisions remain with the relevant licencing bodies.

8. Availability and changes

We aim to keep GunCerts available, relevant, and reasonably up to date, but:

  • Features may change or be removed.
  • Temporary downtime may occur.
  • We may update the app to reflect legal, administrative, procedural, or platform requirements where reasonably practicable.
  • We do not guarantee that every legal, regulatory, administrative, or licencing change will be reflected immediately or before you use the app.

9. Limitation of liability

To the extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential losses.
  • We are not responsible for errors caused by incorrect, incomplete, or outdated user input or supporting documents.
  • We are not responsible for losses arising from changes to South African law, regulation, policy, forms, licencing criteria, administrative practice, or the interpretation or application of those requirements by any authority.
  • We are not responsible for any refusal, delay, rejection, request for further information, or other outcome relating to an application submitted to any authority.
  • Our total liability is limited to the amount you paid for the app or feature giving rise to the claim.

Nothing in these Terms limits liability where it would be unlawful to do so.

10. Privacy

Your use of GunCerts is also governed by our Privacy Policy, which explains how information is handled.

11. Termination

You may stop using GunCerts at any time. We may suspend or terminate access if the app is misused or used unlawfully.

12. Governing law

These Terms are governed by the laws of England and Wales.

GunCerts is designed to assist with South African firearm-related document preparation and processes, which remain subject to applicable South African law and the requirements of the relevant authorities.

Specifically, the following South African laws apply:

  • Firearms Control Act 60 of 2000.
  • Protection of Personal Information Act 4 of 2013 (POPIA).

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
